Walnut Creek Assisted Living Abuse Attorney

Holding Assisted Living Facilities Accountable for Resident Harm in Contra Costa County

Walnut Creek Assisted Living Abuse Attorneys Families trust assisted living facilities and memory care communities to provide safe housing, daily support, supervision, and respectful care for older adults. When a loved one enters an assisted living facility in Walnut Creek, the facility is responsible for recognizing risks, responding to changing needs, and protecting residents from preventable harm.

At Stebner, Gertler, & Guadagni, we represent seniors and families in Walnut Creek and throughout Contra Costa County in cases involving assisted living abuse, assisted living neglect, assisted living negligence, and serious assisted living injury. If you need a Walnut Creek assisted living abuse attorney, our team can investigate what happened and pursue accountability from negligent facilities, corporate operators, and other responsible parties.

Assisted living abuse often begins with facility-wide failures. Understaffing, poor training, ignored care plans, unsafe conditions, medication errors, and inadequate memory care supervision can all place vulnerable residents at risk. Our attorneys work to uncover the truth, preserve evidence, and help families take action after preventable harm.

Key Takeaways: Assisted Living Abuse Cases in Walnut Creek

  • California Protections: The California Elder Abuse Act (EADACPA) provides legal remedies for seniors and dependent adults harmed by abuse, neglect, or reckless disregard for their safety.
  • Common Claims: Assisted living abuse cases may involve falls, medication errors, dehydration, malnutrition, emotional abuse, physical abuse, sexual assault, or assisted living death.
  • Memory Care Risks: Residents with dementia or cognitive decline may be especially vulnerable to wandering, neglect, resident-on-resident harm, and memory care sexual assault.
  • Important Evidence: Care plans, incident reports, staffing schedules, medication logs, photographs, witness statements, and prior complaints can help prove assisted living negligence.

Why Assisted Living Abuse Happens

Assisted living facilities often care for residents who need help with medication, meals, hygiene, mobility, memory-related symptoms, and daily routines. These residents may not require hospital-level care, but they still need consistent supervision and trained caregivers. When facilities fail to provide that support, preventable injuries can happen quickly.

Assisted Living Understaffing

Assisted living understaffing can leave residents waiting too long for help with basic needs. When too few caregivers are available, residents may miss meals, remain in soiled clothing, experience medication delays, suffer preventable falls, or go without timely medical attention.

Assisted Living Negligence

Assisted living negligence occurs when a facility fails to provide the care, monitoring, and safety measures a resident needs. This may include ignoring fall risks, failing to update care plans, mishandling medications, allowing unsafe conditions, or failing to transfer a resident to a higher level of care when their needs increase.

Memory Care Sexual Assault

Memory care residents are especially vulnerable because they may have difficulty reporting abuse or may not be believed when they do. Facilities must have proper screening, staffing, supervision, security, and reporting systems in place. When memory care sexual assault occurs, the facility’s policies, staffing records, prior complaints, and response should be closely investigated.

Why Choose Stebner, Gertler, & Guadagni?

Assisted living abuse litigation requires focused experience with California elder abuse law, facility regulations, medical evidence, and the corporate practices that often contribute to resident harm.

  • Decades of Elder Abuse Experience: Our attorneys have spent decades representing seniors and families harmed by abuse, neglect, and institutional misconduct.
  • Detailed Facility Investigations: We examine care records, staffing data, inspection histories, policies, ownership practices, and internal documentation to identify systemic failures.
  • Trial-Ready Advocacy: We prepare cases for litigation from the beginning, giving families stronger leverage when pursuing accountability and compensation.
  • No Upfront Fees: We handle assisted living abuse cases on a contingency fee basis, meaning families pay no attorney’s fees unless we recover compensation.

Common Assisted Living Injuries

Many assisted living injuries are preventable when facilities provide adequate supervision, safe conditions, and timely care. Serious injuries may indicate that a facility ignored warning signs or failed to respond appropriately.

  • Falls and Fractures: Residents with mobility challenges need fall-risk assessments, safe walkways, supervision, and assistance with transfers.
  • Medication-Related Injuries: Missed doses, incorrect medications, overmedication, or medication delays can cause serious health complications.
  • Dehydration and Malnutrition: Residents who need help eating or drinking may decline quickly when staff fail to monitor intake.
  • Pressure Injuries: Residents with limited mobility may develop pressure ulcers when they are not repositioned, cleaned, or monitored properly.
  • Wandering or Elopement Injuries: Memory care residents may suffer serious harm if a facility fails to secure doors, monitor exits, or supervise residents who are prone to wandering.

Warning Signs of Assisted Living Abuse and Neglect

Families in Walnut Creek should pay close attention to changes in a loved one’s physical condition, behavior, hygiene, and living environment. Warning signs may include:

  • Frequent Falls: Repeated falls may suggest inadequate supervision, poor staffing, unsafe conditions, or failure to follow a resident’s care plan.
  • Unexplained Bruises or Fractures: These injuries may indicate rough handling, physical abuse, improper restraint use, or neglect.
  • Sudden Weight Loss: Malnutrition and dehydration can occur when staff fail to assist residents with meals or monitor food and fluid intake.
  • Poor Hygiene: Dirty clothing, soiled bedding, body odor, untreated infections, or unsafe living conditions may indicate assisted living neglect.
  • Medication Problems: Missed doses, incorrect medications, overmedication, or delayed medication can lead to hospitalization or serious decline.
  • Fearfulness or Withdrawal: A resident who becomes anxious, quiet, depressed, or fearful around certain staff members may be experiencing abuse or intimidation.
  • Unexplained Hospital Visits: Repeated emergency transfers may suggest that the facility is failing to safely manage the resident’s care needs.

Walnut Creek & Contra Costa County Resources

If your loved one is in immediate danger, call 911 or contact local law enforcement. Families may also report assisted living abuse or neglect through the following resources:

Note: Regulatory agencies may investigate complaints and issue citations, but they do not recover financial compensation for injured residents or grieving families. A civil lawsuit may be necessary to pursue damages for medical expenses, pain and suffering, and wrongful death.

How We Investigate Assisted Living Abuse Cases

At Stebner, Gertler, & Guadagni, we investigate assisted living abuse cases by looking beyond the facility’s explanation. Our goal is to determine whether the harm was preventable and whether the facility’s conduct caused or contributed to the injury.

  1. Review Care and Facility Records: We analyze care plans, medication logs, incident reports, staffing schedules, transfer notes, and internal documentation.
  2. Examine Staffing and Supervision: We investigate whether the facility had enough trained caregivers to meet residents’ needs and prevent foreseeable harm.
  3. Consult Qualified Experts: We work with medical and elder care professionals to determine whether the facility failed to meet accepted standards of care.
  4. Investigate Corporate Responsibility: We examine whether ownership, management, or corporate cost-cutting contributed to unsafe conditions, poor staffing, or inadequate care.

Compensation Available in Assisted Living Abuse Cases

When assisted living abuse, neglect, or negligence causes injury or death, victims and families may be entitled to pursue compensation. Depending on the facts of the case, damages may include:

  • Medical expenses and corrective treatment
  • Pain, suffering, and emotional distress
  • Costs associated with transferring the resident to a safer facility
  • Punitive damages in cases involving reckless or intentional misconduct
  • Wrongful death damages after a preventable assisted living death

My mother recently moved into the memory care unit of a very well-regarded senior living facility. In the first month in their memory care unit, she had two falls. The 2nd fall was catastrophic. The care facility was negligent due to many factors. The Stebner, Gertler & Guadagni team, and all the other associates who participated in our mother's case worked very hard to get justice for my mom’s fall. Kathryn Stebner was strong, tenacious, and brilliant in leading this case. Karman Guadagni was super kind and knew all the right questions to ask to dig into our case. Kelsey Craven was awesome as our main guide through this whole process. Everyone was so helpful and caring in providing legal guidance and made the whole daunting process bearable. We can only hope this case would spark a change in the procedures and training for quality and safety in memory care in the many senior living facilities managed by this company.

Our 85-year-old mother, who still danced with remarkable rhythm and joy, lived at a well-known assisted living and memory care facility run by a national corporation. One early morning, we received a devastating call that she had fallen and been rushed to the hospital. Doctors diagnosed a fractured hip that required surgery, but the pain and complications that followed were heartbreaking. Over the next month, we watched helplessly as her health deteriorated rapidly until she passed away—robbing our family of her warmth and joy far too soon. Conflicting accounts from the facility staff left us heartbroken and suspicious of negligence and a possible cover-up. Desperate for answers and justice, we turned to online research and contacted the law firm of Stebner, Gertler & Guadagni based on their compelling reviews. From the very first call, their prompt response gave us hope. Attorney Karman Guadagni spoke with me the same day, offering genuine compassion and clear guidance during those overwhelming early days. Karman and her dedicated team took on our case with unwavering commitment. Through a year of meticulous investigation, they uncovered shocking instances of neglect and mismanagement that contributed to our mother’s suffering. Their skill and tenacity secured a substantial settlement that went beyond our expectations. While no amount of money can heal the pain of losing our dear mother or erase the anguish she endured in her final weeks, knowing this assisted living corporation was held accountable—and may now implement changes to protect other vulnerable elders—brought us a measure of justice and peace. We are forever grateful to Karman Guadagni and her entire team for fighting so fiercely on our behalf.

Our mother died prematurely due to callous and negligent care at a live-in care facility in the north bay area. It was the only facility with an opening at the time we needed to place her and no openings came up during the course of her stay where she could be relocated. The facility was understaffed, overworked and without proper support from management or the owners of the facility thereby creating an unfavorable climate for proper patient care. Our mother suffered numerous injuries while under the care and custody of the facility with no effort by staff to ameliorate the unsafe conditions under which she was living...thereby reducing the danger to her wellbeing...which resulted as medically proven contributing factors to her untimely death. The manner of death listed on her death certificate was other than "natural" due to those injuries. We contacted the law firm of Stebner, Gertler & Guadagni to assist us due to the horrible conditions our mother endured. They readily took the case which brought us much relief. Our family would like to give special recognition to attorneys Kathryn Stebner, Karman Guadagni (lead counsel) and Kelsey Craven as well as many staff members for their expert attention to detail in the handling of our case. They were approachable, compassionate and very well versed in Elder Abuse law. They negotiated an amazing conclusion to our legal efforts so that we could have closure in the loss of our mother and a feeling of justice for the lack of proper care she suffered. We will be forever grateful for the wonderful service they provided to us in our time of need.

My mom lost her ability to walk (due to a serious head injury) after being neglected at a memory care facility. I contacted Kirsten Fish (at NFK Law), and she partnered with Karman Guadagni at Stebner Gertler & Guadagni. From the very first moment I met with them, I felt reassured, supported, and stronger. My mother did not deserve to be in this condition, and I felt so hurt and frustrated by the memory care's lack of accountability and callousness. Karman and Kirsten were so intentional and kind, and they fought very hard to get the facility to own their multiple mistakes. My mom still cannot walk, but the care she receives now is spectacular. I owe Kirsten and Karman so much for taking her case and fighting on her behalf. She will likely live a longer, more comfortable life. I never thought I would ever pursue litigation, but after dealing with both NFK and SGG law firms, I know I did the right thing with the most amazing team.

Stebner Gertler & Guadagni just won a case on behalf of our mother who passed away after receiving negligent care from a rehabilitation facility. They were able to get us an award which was a good deal more than what we expected. Throughout the process these attorneys and their staff were extremely responsive, professional, kind and quite likable! They aren’t just great attorneys, they’re also great people. God forbid I ever need such services again but, if I did, I would use them again without hesitation. They deserve the best ratings, 5 stars! I highly recommend them!

My brothers and I were so fortunate to be referred to Stebner Gertler & Guadagni, a law firm that specializes in Elder Abuse litigation. Our mom passed away due to negligence committed by a well regarded memory care facility in the Bay Area. We worked with Karman Guadagni, the managing partner at SG&G. Karman was very professional, capable, honest and compassionate. She managed our case with care and attention and she kept us informed as to the progress of our case and the firm's investigation. We also want to thank Kathryn Stebner, an experienced, strategic negotiator, and Deena Zacharin, a warm and compassionate fact finder who rounded out our excellent team at SG&G. There is no winner in a situation such as this, but the most important aspect to our settlement was that Karman took the initiative to request that the owner of the facility write a letter to my family detailing the changes that were made to policies and procedures based on my mom's care and ultimate death. Lastly, for those of you that might be intimidated to call a law firm, I would encourage you to make that call to SG&G. You will find their staff to be extremely helpful, friendly and easy to talk to. Thank you SG&G.

Frequently Asked Questions

Yes. A facility may be liable if it knew or should have known that a resident posed a safety risk and failed to supervise, intervene, separate residents, or update the care plan.

Yes. If assisted living abuse, neglect, or negligence contributed to a resident’s death, surviving family members may be able to pursue a wrongful death claim and other legal remedies.

No. A state complaint may lead to an investigation or citation, but it does not recover compensation for medical bills, pain and suffering, or wrongful death. A separate civil claim is usually required.

Understaffing can cause delayed response times, missed medications, poor hygiene, falls, dehydration, malnutrition, and failure to notice medical decline. Staffing records may help show whether the facility failed to provide adequate care.

You should contact an attorney as soon as you suspect abuse, neglect, or unexplained injury. Early legal involvement can help preserve records, identify witnesses, document injuries, and protect the resident from further harm.

Helpful evidence may include care plans, medication logs, staffing schedules, incident reports, inspection findings, photographs, witness statements, transfer records, and medical records after the injury.

Make sure your loved one receives medical care, document visible injuries or unsafe conditions, save written communication from the facility, write down what staff tell you, and speak with an attorney before key records disappear.

Memory care residents may have dementia, communication challenges, wandering risks, or difficulty reporting harm. Facilities must provide proper supervision, security, training, and safeguards to protect them from preventable abuse or neglect.
