Hayward Elder Abuse Attorney

Experienced Elder Abuse Attorneys Helping Seniors in Hayward, CA

hayward elder abuse lawyerWhen a family member enters a skilled nursing facility or assisted living center in Hayward, there is an expectation of professional care. Families trust these institutions to provide the medical attention and personal dignity their loved ones deserve. Unfortunately, systemic failures within the long-term care industry often lead to preventable injuries, emotional trauma, and wrongful death.

Stebner, Gertler, & Guadagni represents elders and their families in Hayward and throughout Alameda County who have suffered due to institutional misconduct. We focus on litigation that addresses the root causes of elder abuse, moving beyond simple negligence to hold corporations accountable for the intentional understaffing and budget-cutting measures that endanger residents.

If you suspect that a facility is failing to meet California’s mandated standards of care, taking prompt action is essential. Our firm provides the legal authority and experience necessary to investigate these claims and secure justice for those who cannot fight for themselves.

Key Takeaways: Elder Abuse Litigation in Hayward

  • California Law Protections: The Elder Abuse and Dependent Adult Civil Protection Act (EADACPA) provides specific legal remedies for victims, including the recovery of attorney’s fees and pain and suffering damages in cases of recklessness or malice.
  • Institutional Accountability: Most elder abuse in Hayward stems from corporate decisions to prioritize profits over resident safety.
  • Time Sensitivity: Statutes of limitations apply to personal injury and wrongful death claims. Evidence in nursing home cases, such as staffing logs and medical records, must be preserved immediately.
  • Reporting Requirements: Suspected abuse should be reported to the Alameda County Adult Protective Services and the Long-Term Care Ombudsman.

Why Elder Abuse Occurs in Hayward Care Facilities

Abuse is rarely the result of a single “bad apple” employee. In our experience at Stebner, Gertler, & Guadagni, we find that the vast majority of physical elder abuse and neglect cases are symptoms of institutional failure.

Chronic Understaffing

Many facilities in the East Bay operate with the bare minimum number of staff required by law—and sometimes less. When one nurse is responsible for dozens of high-acuity patients, essential tasks like repositioning, hydration, and wound care are missed.

Prioritizing Profit Over Care

Private equity firms and large corporations own many Hayward nursing homes. These entities often implement aggressive cost-cutting measures, reducing expenditures on supplies, training, and specialized nursing staff to increase their bottom line.

Inadequate Training

Staff members are often tasked with handling complex medical needs without sufficient background or ongoing education. This leads to medication errors, improper use of restraints, and a failure to recognize early warning signs of infection or decline.

Why Choose Stebner, Gertler, & Guadagni?

Selecting a firm to represent an aging family member requires a balance of high-level legal authority and genuine empathy. Our practice is built on more than 35 years of dedicated elder abuse litigation, led by pioneers who have shaped the very laws that protect California’s seniors today.

  • Pioneering Experience: Our founder, Kathryn Stebner, filed the first elder abuse lawsuit in California history in 1987. Since then, she has testified before the State Legislature and co-authored the definitive legal guide on elder law litigation for the California CEB.
  • Proven Results against Corporations: We have a legacy of securing significant recoveries, including a $33 million wrongful death verdict in an assisted living case and $30 million in a Contra Costa County matter. These results reflect our ability to hold large healthcare corporations accountable for systemic neglect.
  • Academic and Professional Leadership: Our attorneys are more than practitioners; they are educators. Managing Partner Karman Guadagni serves as a guest professor at Stanford Law, ensuring our trial strategies remain at the cutting edge of the field.
  • A Commitment to Change: We view litigation as a tool for industry-wide reform. By targeting the root causes of harm—such as intentional understaffing—we push for safer standards in Hayward and beyond. We work on a 100% contingency basis, meaning you pay no fees unless we win your case.

Families across California trust Stebner, Gertler & Guadagni to hold negligent facilities accountable.

My mother recently moved into the memory care unit of a very well-regarded senior living facility. In the first month in their memory care unit, she had two falls. The 2nd fall was catastrophic. The care facility was negligent due to many factors. The Stebner, Gertler & Guadagni team, and all the other associates who participated in our mother's case worked very hard to get justice for my mom’s fall. Kathryn Stebner was strong, tenacious, and brilliant in leading this case. Karman Guadagni was super kind and knew all the right questions to ask to dig into our case. Kelsey Craven was awesome as our main guide through this whole process. Everyone was so helpful and caring in providing legal guidance and made the whole daunting process bearable. We can only hope this case would spark a change in the procedures and training for quality and safety in memory care in the many senior living facilities managed by this company.

Our 85-year-old mother, who still danced with remarkable rhythm and joy, lived at a well-known assisted living and memory care facility run by a national corporation. One early morning, we received a devastating call that she had fallen and been rushed to the hospital. Doctors diagnosed a fractured hip that required surgery, but the pain and complications that followed were heartbreaking. Over the next month, we watched helplessly as her health deteriorated rapidly until she passed away—robbing our family of her warmth and joy far too soon. Conflicting accounts from the facility staff left us heartbroken and suspicious of negligence and a possible cover-up. Desperate for answers and justice, we turned to online research and contacted the law firm of Stebner, Gertler & Guadagni based on their compelling reviews. From the very first call, their prompt response gave us hope. Attorney Karman Guadagni spoke with me the same day, offering genuine compassion and clear guidance during those overwhelming early days. Karman and her dedicated team took on our case with unwavering commitment. Through a year of meticulous investigation, they uncovered shocking instances of neglect and mismanagement that contributed to our mother’s suffering. Their skill and tenacity secured a substantial settlement that went beyond our expectations. While no amount of money can heal the pain of losing our dear mother or erase the anguish she endured in her final weeks, knowing this assisted living corporation was held accountable—and may now implement changes to protect other vulnerable elders—brought us a measure of justice and peace. We are forever grateful to Karman Guadagni and her entire team for fighting so fiercely on our behalf.

Our mother died prematurely due to callous and negligent care at a live-in care facility in the north bay area. It was the only facility with an opening at the time we needed to place her and no openings came up during the course of her stay where she could be relocated. The facility was understaffed, overworked and without proper support from management or the owners of the facility thereby creating an unfavorable climate for proper patient care. Our mother suffered numerous injuries while under the care and custody of the facility with no effort by staff to ameliorate the unsafe conditions under which she was living...thereby reducing the danger to her wellbeing...which resulted as medically proven contributing factors to her untimely death. The manner of death listed on her death certificate was other than "natural" due to those injuries. We contacted the law firm of Stebner, Gertler & Guadagni to assist us due to the horrible conditions our mother endured. They readily took the case which brought us much relief. Our family would like to give special recognition to attorneys Kathryn Stebner, Karman Guadagni (lead counsel) and Kelsey Craven as well as many staff members for their expert attention to detail in the handling of our case. They were approachable, compassionate and very well versed in Elder Abuse law. They negotiated an amazing conclusion to our legal efforts so that we could have closure in the loss of our mother and a feeling of justice for the lack of proper care she suffered. We will be forever grateful for the wonderful service they provided to us in our time of need.

My mom lost her ability to walk (due to a serious head injury) after being neglected at a memory care facility. I contacted Kirsten Fish (at NFK Law), and she partnered with Karman Guadagni at Stebner Gertler & Guadagni. From the very first moment I met with them, I felt reassured, supported, and stronger. My mother did not deserve to be in this condition, and I felt so hurt and frustrated by the memory care's lack of accountability and callousness. Karman and Kirsten were so intentional and kind, and they fought very hard to get the facility to own their multiple mistakes. My mom still cannot walk, but the care she receives now is spectacular. I owe Kirsten and Karman so much for taking her case and fighting on her behalf. She will likely live a longer, more comfortable life. I never thought I would ever pursue litigation, but after dealing with both NFK and SGG law firms, I know I did the right thing with the most amazing team.

Stebner Gertler & Guadagni just won a case on behalf of our mother who passed away after receiving negligent care from a rehabilitation facility. They were able to get us an award which was a good deal more than what we expected. Throughout the process these attorneys and their staff were extremely responsive, professional, kind and quite likable! They aren’t just great attorneys, they’re also great people. God forbid I ever need such services again but, if I did, I would use them again without hesitation. They deserve the best ratings, 5 stars! I highly recommend them!

My brothers and I were so fortunate to be referred to Stebner Gertler & Guadagni, a law firm that specializes in Elder Abuse litigation. Our mom passed away due to negligence committed by a well regarded memory care facility in the Bay Area. We worked with Karman Guadagni, the managing partner at SG&G. Karman was very professional, capable, honest and compassionate. She managed our case with care and attention and she kept us informed as to the progress of our case and the firm's investigation. We also want to thank Kathryn Stebner, an experienced, strategic negotiator, and Deena Zacharin, a warm and compassionate fact finder who rounded out our excellent team at SG&G. There is no winner in a situation such as this, but the most important aspect to our settlement was that Karman took the initiative to request that the owner of the facility write a letter to my family detailing the changes that were made to policies and procedures based on my mom's care and ultimate death. Lastly, for those of you that might be intimidated to call a law firm, I would encourage you to make that call to SG&G. You will find their staff to be extremely helpful, friendly and easy to talk to. Thank you SG&G.

Recognizing the Signs of Physical Elder Abuse

Physical abuse and neglect often leave visible markers, but they can also be masked by a resident’s existing health conditions. Families must remain vigilant for specific red flags that indicate a departure from standard care.

  • Pressure Sores (Bedsores): These are almost always preventable. A Stage III or IV pressure ulcer is a definitive sign of neglect, indicating that a resident was left immobile for extended periods without proper turning and positioning.
  • Unexplained Falls: While elders are at higher risk for falls, facilities are required to implement fall-prevention protocols. Frequent “accidents” often suggest a lack of supervision or environmental hazards.
  • Dehydration and Malnutrition: Sudden weight loss or physical weakness may indicate that the facility is failing to assist the resident with basic intake.
  • Frequent Infections: Recurring UTIs or respiratory infections can stem from poor hygiene practices and a failure to maintain a clean environment.
  • Unexplained Bruising or Fractures: Physical elder abuse may manifest as injuries in various stages of healing, especially in areas like the upper arms or torso.

Reporting Elder Abuse in Hayward and Alameda County

If a resident is in immediate danger, call 911 or the Hayward Police Department. For ongoing concerns regarding neglect or institutional failures, you should contact local regulatory bodies to initiate an official investigation.

Local Resources for Hayward Residents

  • Alameda County Adult Protective Services (APS): Call (510) 577-3500 to report abuse occurring in home settings or facilities.
  • Alameda County Long-Term Care Ombudsman: This office investigates complaints made by or on behalf of residents in long-term care facilities. They can be reached at (510) 638-6878.
  • California Department of Public Health (CDPH): The East Bay District Office oversees licensing and certification for nursing homes in Hayward. Filing a formal complaint here triggers a state investigation.

While these agencies provide essential oversight, they cannot recover compensation for the victim or force a facility to pay for medical expenses and pain and suffering. That is where a Hayward elder abuse attorney becomes necessary.

The Role of Stebner, Gertler, & Guadagni

As a specialized elder abuse law firm, we do more than file paperwork. We conduct deep-dive investigations into the financial and operational structures of the facilities we sue. Our approach involves:

  1. Forensic Record Review: We analyze medical charts, MARs (Medication Administration Records), and staffing rosters to find discrepancies that indicate neglect.
  2. Staffing Analysis: We look at payroll records to determine if the facility was intentionally short-staffed during the period the abuse occurred.
  3. Expert Consultation: We work with leading geriatricians and nursing experts to testify on how the facility’s conduct fell below the standard of care.
  4. Litigation and Trial: We are trial lawyers. While many firms look for a quick settlement, we prepare every case for the courtroom to ensure maximum accountability.

Legal Options and Recoverable Damages

California law is uniquely protective of its senior citizens. Under the Elder Abuse Act, if we can prove by clear and convincing evidence that a facility acted with recklessness, oppression, or malice, the legal remedies expand significantly.

Victims and their families may seek:

  • Medical Expenses: Coverage for past and future hospitalizations, surgeries, and rehabilitative care necessitated by the abuse.
  • Pain and Suffering: Compensation for the physical and emotional trauma endured by the elder.
  • Wrongful Death Damages: If neglect led to a loss of life, heirs can seek compensation for the loss of companionship and funeral expenses.
  • Attorney’s Fees: The law allows for the recovery of legal fees in certain elder abuse cases, making it possible for families to pursue justice regardless of their financial situation.

Frequently Asked Questions

Retaliation is illegal under California law. If you fear retaliation, we can assist in documenting these concerns and involving the appropriate regulatory agencies to ensure the resident’s safety while the legal process moves forward.

Learn more about reliation in the face of an elder facility claim.

Yes. In fact, many victims of elder abuse have cognitive impairments. We rely on physical evidence, medical records, and witness testimony to build a case even when the victim cannot testify.

Learn more about how to sue a facility when a victim cannot easily testify due to dementia.

No. Stebner, Gertler, & Guadagni provides initial consultations at no cost. We work on a contingency fee basis, meaning we only receive payment if we successfully recover compensation for you.

We obtain internal documents called “Cost Reports” and payroll data that facilities are required to submit to the government. We compare these to the actual census (number of residents) to demonstrate that there were not enough hands on deck to provide safe care.

Learn more about how to prove a facility was understaffed.

Generally, the statute of limitations for personal injury is two years from the date of the injury. However, if the case involves medical malpractice, the timelines can be shorter and more complex. It is best to consult an attorney as soon as you suspect harm.

Learn more about the statutes of limitations in relation to your case.

Neglect is the failure of those who have care or custody of an elder to exercise the degree of care that a reasonable person in a like position would exercise. This includes failure to provide medical care, protect from health and safety hazards, or prevent malnutrition.

Learn more about how California law defines elder neglect, what families must prove in a claim, and how systemic failures in care facilities can lead to legal accountability.

This is a common defense. Nursing homes often claim bedsores or falls are inevitable. Our job is to prove that these events were preventable and occurred because the facility failed to follow its own care plans or state-mandated protocols.

Learn when families should question the explanation of an injury.

An ombudsman is a government-funded advocate who helps resolve issues and investigates complaints for the state. They do not represent you legally or seek financial compensation. A lawyer files a civil lawsuit to recover damages and hold the facility legally liable.
