Hayward Home Health Agency Negligence Lawyer

Experience Attorneys Holding Home Health Agencies Accountable in Hayward, CA

Hayward Home Health Agency Negligence LawyersWhen you entrust a home health agency with the care of an elderly or disabled family member, you are placing immense faith in their professional standards. You expect that the caregivers entering your home in Hayward are vetted, trained, and supervised. Unfortunately, many agencies prioritize profit margins over patient safety, leading to systemic neglect that can have devastating physical and emotional consequences.

At Stebner, Gertler, & Guadagni, we hold these agencies accountable. We understand that home health negligence isn’t just a clinical error; it is a profound breach of trust that leaves vulnerable individuals at risk in the very place they should feel safest. If an agency’s failure to provide adequate care has resulted in injury or the worsening of a medical condition, our legal team is prepared to investigate the institutional failures that allowed it to happen.

Key Takeaways: Home Health Negligence in California

  • Agency Responsibility: Home health agencies are legally required to properly screen, train, and supervise their staff.
  • Signs of Neglect: Unexplained falls, Stage 2+ pressure sores (bedsores), and severe dehydration are often indicators of systemic care failures.
  • Institutional Issues: Negligence is frequently rooted in understaffing, high turnover, and a lack of oversight from agency management.
  • Legal Protections: The California Elder Abuse and Dependent Adult Civil Protection Act provides enhanced remedies for those harmed by reckless neglect.
  • Reporting Matters: Suspected abuse should be reported to the Alameda County Adult Protective Services (APS) immediately.

Why Home Health Negligence Occurs

While a single caregiver may be the one who fails to provide care, the root cause is often found at the corporate level. Home health agencies in Alameda County frequently struggle with staffing shortages, but they continue to accept new patients they cannot safely manage.

Understaffing and Overworked Caregivers

When an agency is understaffed, caregivers are rushed. They may skip essential tasks like repositioning a bedbound patient or ensuring proper hydration. This “task-oriented” care ignores the holistic needs of the patient, leading to preventable complications.

Lack of Training and Supervision

Many in-home caregivers are sent into residences without adequate training for a patient’s specific medical needs. If an agency fails to send a Registered Nurse (RN) to supervise a home health aide or fails to update a care plan as a patient’s condition changes, they are legally liable for the resulting harm.

Cost-Cutting Measures

To maximize revenue, some agencies hire underqualified staff at lower wages or fail to perform the rigorous background checks required by California law. When profits are prioritized over the “standard of care,” the elderly pay the price.

Why Choose Stebner, Gertler, & Guadagni?

My mother recently moved into the memory care unit of a very well-regarded senior living facility. In the first month in their memory care unit, she had two falls. The 2nd fall was catastrophic. The care facility was negligent due to many factors. The Stebner, Gertler & Guadagni team, and all the other associates who participated in our mother's case worked very hard to get justice for my mom’s fall. Kathryn Stebner was strong, tenacious, and brilliant in leading this case. Karman Guadagni was super kind and knew all the right questions to ask to dig into our case. Kelsey Craven was awesome as our main guide through this whole process. Everyone was so helpful and caring in providing legal guidance and made the whole daunting process bearable. We can only hope this case would spark a change in the procedures and training for quality and safety in memory care in the many senior living facilities managed by this company.

Our 85-year-old mother, who still danced with remarkable rhythm and joy, lived at a well-known assisted living and memory care facility run by a national corporation. One early morning, we received a devastating call that she had fallen and been rushed to the hospital. Doctors diagnosed a fractured hip that required surgery, but the pain and complications that followed were heartbreaking. Over the next month, we watched helplessly as her health deteriorated rapidly until she passed away—robbing our family of her warmth and joy far too soon. Conflicting accounts from the facility staff left us heartbroken and suspicious of negligence and a possible cover-up. Desperate for answers and justice, we turned to online research and contacted the law firm of Stebner, Gertler & Guadagni based on their compelling reviews. From the very first call, their prompt response gave us hope. Attorney Karman Guadagni spoke with me the same day, offering genuine compassion and clear guidance during those overwhelming early days. Karman and her dedicated team took on our case with unwavering commitment. Through a year of meticulous investigation, they uncovered shocking instances of neglect and mismanagement that contributed to our mother’s suffering. Their skill and tenacity secured a substantial settlement that went beyond our expectations. While no amount of money can heal the pain of losing our dear mother or erase the anguish she endured in her final weeks, knowing this assisted living corporation was held accountable—and may now implement changes to protect other vulnerable elders—brought us a measure of justice and peace. We are forever grateful to Karman Guadagni and her entire team for fighting so fiercely on our behalf.

Our mother died prematurely due to callous and negligent care at a live-in care facility in the north bay area. It was the only facility with an opening at the time we needed to place her and no openings came up during the course of her stay where she could be relocated. The facility was understaffed, overworked and without proper support from management or the owners of the facility thereby creating an unfavorable climate for proper patient care. Our mother suffered numerous injuries while under the care and custody of the facility with no effort by staff to ameliorate the unsafe conditions under which she was living...thereby reducing the danger to her wellbeing...which resulted as medically proven contributing factors to her untimely death. The manner of death listed on her death certificate was other than "natural" due to those injuries. We contacted the law firm of Stebner, Gertler & Guadagni to assist us due to the horrible conditions our mother endured. They readily took the case which brought us much relief. Our family would like to give special recognition to attorneys Kathryn Stebner, Karman Guadagni (lead counsel) and Kelsey Craven as well as many staff members for their expert attention to detail in the handling of our case. They were approachable, compassionate and very well versed in Elder Abuse law. They negotiated an amazing conclusion to our legal efforts so that we could have closure in the loss of our mother and a feeling of justice for the lack of proper care she suffered. We will be forever grateful for the wonderful service they provided to us in our time of need.

My mom lost her ability to walk (due to a serious head injury) after being neglected at a memory care facility. I contacted Kirsten Fish (at NFK Law), and she partnered with Karman Guadagni at Stebner Gertler & Guadagni. From the very first moment I met with them, I felt reassured, supported, and stronger. My mother did not deserve to be in this condition, and I felt so hurt and frustrated by the memory care's lack of accountability and callousness. Karman and Kirsten were so intentional and kind, and they fought very hard to get the facility to own their multiple mistakes. My mom still cannot walk, but the care she receives now is spectacular. I owe Kirsten and Karman so much for taking her case and fighting on her behalf. She will likely live a longer, more comfortable life. I never thought I would ever pursue litigation, but after dealing with both NFK and SGG law firms, I know I did the right thing with the most amazing team.

Stebner Gertler & Guadagni just won a case on behalf of our mother who passed away after receiving negligent care from a rehabilitation facility. They were able to get us an award which was a good deal more than what we expected. Throughout the process these attorneys and their staff were extremely responsive, professional, kind and quite likable! They aren’t just great attorneys, they’re also great people. God forbid I ever need such services again but, if I did, I would use them again without hesitation. They deserve the best ratings, 5 stars! I highly recommend them!

My brothers and I were so fortunate to be referred to Stebner Gertler & Guadagni, a law firm that specializes in Elder Abuse litigation. Our mom passed away due to negligence committed by a well regarded memory care facility in the Bay Area. We worked with Karman Guadagni, the managing partner at SG&G. Karman was very professional, capable, honest and compassionate. She managed our case with care and attention and she kept us informed as to the progress of our case and the firm's investigation. We also want to thank Kathryn Stebner, an experienced, strategic negotiator, and Deena Zacharin, a warm and compassionate fact finder who rounded out our excellent team at SG&G. There is no winner in a situation such as this, but the most important aspect to our settlement was that Karman took the initiative to request that the owner of the facility write a letter to my family detailing the changes that were made to policies and procedures based on my mom's care and ultimate death. Lastly, for those of you that might be intimidated to call a law firm, I would encourage you to make that call to SG&G. You will find their staff to be extremely helpful, friendly and easy to talk to. Thank you SG&G.

Warning Signs of Home Care Negligence

Identifying negligence in a home setting can be difficult, as there are no “third-party” witnesses like there might be in a Hayward nursing home. Families must remain vigilant for these red flags:

  • Pressure Ulcers (Bedsores): These are almost always preventable with proper turning and positioning. Their presence often signals that a patient has been left unattended for hours.
  • Medication Errors: Missing doses, over-medication, or administering the wrong prescriptions can lead to toxicity or a rapid decline in health.
  • Unexplained Weight Loss: This may indicate the caregiver is failing to assist with feeding or failing to monitor nutritional intake.
  • Poor Personal Hygiene: Unchanged linens, infrequent bathing, or the presence of a strong urine odor suggest a breakdown in basic care duties.
  • Frequent Emergency Room Visits: If a loved one is repeatedly hospitalized for “failure to thrive,” dehydration, or falls, the home health agency’s protocols must be scrutinized.

Reporting Home Health Abuse in Hayward

If you suspect that a home health agency is neglecting a loved one, your first priority is their safety. In Hayward and throughout Alameda County, there are resources available to intervene.

Local Resources and Reporting Agencies

  • Alameda County Adult Protective Services (APS): To report abuse or neglect of an elder (65+) or a dependent adult, call the 24-hour hotline at (510) 577-3500 or toll-free at (866) 225-5277.
  • California Department of Public Health (CDPH): Home health agencies are licensed by the state. Filing a formal complaint with the CDPH can trigger an investigation into the agency’s license.
  • California Department of Social Services (CDSS): For issues specifically involving Home Care Organizations (HCOs), the CDSS oversees compliance and consumer protection.

Suing a Home Health Agency for Negligence

Suing a home health agency requires more than proving an accident happened. We must demonstrate that the agency breached the professional standard of care.

Under the California Elder Abuse and Dependent Adult Civil Protection Act (EADACPA), if we can prove by “clear and convincing evidence” that the neglect was reckless, oppressive, or malicious, the law allows for enhanced remedies. This can include the recovery of attorney’s fees and, in cases involving death, the ability for the estate to recover damages for the decedent’s pain and suffering.

The Role of Stebner, Gertler, & Guadagni

Our firm focuses on the “why” behind the injury. We look at the agency’s hiring records, staffing logs, and internal communications. We often find that the agency knew a caregiver was incompetent or that the patient required more care than the agency could provide, yet they did nothing to rectify the situation.

Frequently Asked Questions (FAQs)

Yes. You may be able to file a wrongful death claim to compensate for your losses, as well as a survival action to recover damages for the suffering your parent endured prior to their passing.

Retaliation against a whistleblower or a complainant is illegal under California law. Reporting the agency is a protected activity, and we can help ensure your loved one is moved to a safe environment during the process.

Evidence often includes medical records showing the progression of bedsores or dehydration, photographs of injuries, and the agency’s own “daily logs” which may be incomplete or falsified. We also utilize expert witnesses to testify on what a reasonable agency should have done.

Stebner, Gertler, & Guadagni operates on a contingency fee basis. This means you pay nothing upfront, and we only receive a fee if we successfully recover compensation for your family.

In many cases, yes. Under California law, if an agency “holds itself out” as the provider of care, they can often be held vicariously liable for the negligence of the people they send into your home, regardless of their employment status.

Our firm specializes in cases against professional agencies and corporate entities. If a professional agency was hired to supervise or provide supplemental care and they failed to do so, we can pursue a claim against that agency.

Home care typically refers to non-medical assistance (bathing, cleaning, meal prep), while home health care involves skilled nursing or therapy services ordered by a doctor. Both types of agencies can be held liable for negligence, but different regulations may apply to each.

Generally, for professional negligence, you have one year from the date of discovery or three years from the date of injury. However, elder abuse claims may have different timelines. It is vital to consult a Hayward home health agency negligence lawyer as soon as possible to preserve your rights.
